A LAWSUIT has been filed against Florida-based food delivery app Delivery Dudes alleging that it pays its drivers just 50 to 75 cents per delivery while making them work up to 60 hour weeks.
Like most app-based services, the company classes its workers as independent contractors not eligible for Fair Labor Standards Act (FLSA) protection.
Court documents state that, “In order to avoid paying minimum wages and overtime compensation under the Fair Labor Standards Act, (FLSA) defendants require the drivers to execute independent contractor agreements and therefore claim that they are not employees.”
Delivery Dudes driver Spencer Amadon filed a lawsuit against the company last year demanding $1 million in compensation. The matter was settled out of court for an undisclosed sum.
